Important: TerraPatch offers educational prompts for noticing nature. It does not identify organisms, verify local conditions, establish safety, or provide scientific, medical, veterinary, land-management, or emergency advice.
1. Accepting these terms
By downloading or using TerraPatch, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use TerraPatch. If you are under the age of legal majority where you live, use TerraPatch only with permission from a parent or legal guardian who accepts these terms on your behalf.
2. What TerraPatch provides
TerraPatch combines hand-authored regional almanac material, on-device sun and moon calculations, a private field journal, a home-screen widget, and curated links to independent participation programs. Available content and geographic coverage may vary by region, date, device, and app version.
3. Nature is variable
Phenological events vary from year to year and from one microclimate or individual organism to another. A prompt that something may be blooming, migrating, emerging, nesting, fruiting, or otherwise active is an invitation to look—not a guarantee that it is present at your location.
Sky calculations, coordinates, dates, species names, ecological descriptions, and source material may be incomplete, approximate, outdated, or wrong. Confirm important information with current primary sources and qualified local experts.
4. Safety and responsible observation
Do not use TerraPatch to determine whether a plant, fungus, animal, water body, trail, weather condition, or location is safe. Do not consume, handle, approach, disturb, capture, remove, or treat an organism based on TerraPatch. Respect closures, property boundaries, permits, wildlife guidance, sensitive habitats, and other people.
Use appropriate judgment for weather, terrain, water, wildlife, allergens, toxins, traffic, visibility, and personal ability. In an emergency, contact local emergency services or an appropriate authority; TerraPatch does not provide alerts or emergency assistance.
5. Your field notes and photographs
You retain ownership of observation text and photographs you create or choose (“Your Content”). You are responsible for Your Content and for having the right to record it. Do not use field notes or photographs to invade privacy, trespass, disclose a sensitive species location irresponsibly, or violate another person’s rights.
Your Content is stored locally as described in the Privacy Policy. You are responsible for protecting the device and maintaining another suitably protected copy of anything you cannot afford to lose.
6. Location and widget
Location results depend on Apple’s services, device settings, signal, and surrounding conditions. TerraPatch uses a saved coordinate to select and generate local material, but geographic matching can be imperfect. The widget displays a locally generated snapshot and may be delayed until iOS refreshes it or the app updates it.
7. Participation directory and external services
TerraPatch points toward independent citizen-science programs, land trusts, agencies, and community organizations. It does not operate those programs, enroll users, verify current schedules or eligibility, transmit observations to them, or guarantee their quality or safety. Contact the organization directly and review its current requirements before participating.
External websites, sources, and programs have their own terms and privacy practices. A link does not mean Ecopoiesis endorses every statement, activity, product, or later change at the destination.
8. Acceptable use
You may not use TerraPatch to break the law or facilitate harm; infringe rights; expose protected or sensitive locations irresponsibly; harass, exploit, or endanger people or wildlife; scrape, probe, disrupt, bypass, reverse engineer except where law permits, or compromise the app; remove ownership notices; or reproduce, resell, or commercially exploit the software or original almanac content without written permission.
9. Intellectual property
TerraPatch—including its software, branding, interfaces, original almanac writing, illustrations, arrangements, and design—is owned by Ecopoiesis or its licensors and protected by intellectual-property laws. These terms grant a personal, limited, non-exclusive, non-transferable right to use the app as intended; they do not transfer ownership. Third-party facts, sources, and openly licensed material remain subject to their applicable rights and licenses.
10. Availability and changes
We do not guarantee uninterrupted or error-free operation, coverage for every location or date, continued availability of a particular almanac or external link, or compatibility with every device. We may correct, update, add, remove, or discontinue content and features. Local records may be lost through app removal, device failure, storage corruption, operating-system behavior, or user action.
11. Disclaimer of warranties
To the maximum extent permitted by law, TerraPatch is provided “as is” and “as available.” Ecopoiesis disclaims implied warranties including merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. These disclaimers do not limit consumer rights or warranties that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, Ecopoiesis and its members, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for injury, property loss, lost or exposed observations, reliance on almanac content, missed events, participation in external programs, or loss of data, access, opportunity, or goodwill arising from TerraPatch.
Ecopoiesis’s aggregate liability for a claim relating to TerraPatch will not exceed the greater of the amount you paid for TerraPatch during the 12 months before the claim or US $50. These limits do not apply where prohibited or to liability that cannot lawfully be limited.
13. App Store license
TerraPatch is licensed, not sold. Unless Ecopoiesis supplies a separate custom license through the App Store, Apple’s Standard Licensed Application End User License Agreement applies to the app license. These Terms supplement that license. If a conflict concerns the app license, the applicable App Store license controls.
14. Changes, severability, and waiver
We may update these terms and will post the current version at this URL with its effective date. If a provision is unenforceable, it will be adjusted only as much as necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver.
