1. Accepting these terms
By accessing or using PermaSage, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Services. You must be at least 18 years old and legally able to enter into these terms.
2. The Services
PermaSage helps users record observations, outline a project area, organize permaculture zones, consult reference material, and request automated site analyses. App records are stored on the device and, when iCloud is available, synced through Apple’s CloudKit service to the user’s private iCloud database. Features may change as the product develops.
3. Educational information and AI limitations
PermaSage analyses and recommendations may be generated using artificial intelligence. AI can be incomplete, outdated, misleading, or wrong. It may infer conditions unsupported by the provided details or recommend a species, technique, or schedule that is inappropriate for a particular site. Output is not reviewed by a human expert before it reaches you.
PermaSage cannot determine soil chemistry, contamination, underground utilities, structural stability, flood or fire safety, legal ownership, code compliance, plant edibility or toxicity, pesticide safety, or design suitability for people, animals, or neighboring land. Use current local sources, testing, permits, utility-location services, and qualified professionals where appropriate. You remain responsible for your decisions and actions.
4. Maps and project boundaries
Map imagery, coordinates, measurements, climate information, and other location-based material may be approximate, delayed, or incorrect. Lines drawn or displayed in PermaSage identify a user-selected project area. They are not a survey, title record, legal parcel boundary, easement determination, or authorization to enter or modify land. Confirm ownership, access, boundaries, utilities, restrictions, and permissions independently.
5. Your content
You retain ownership of site information, notes, boundaries, photographs, and other material you provide (“Your Content”). Saved app content is stored on your device and synced through your private iCloud database; Ecopoiesis does not maintain a developer-controlled copy of those saved records.
When you tap Analyze My Land, you give Ecopoiesis, Vercel, and Anthropic a limited right to process the site name, ZIP code, acreage, soil type, topography, and goals included in that request solely to provide, secure, and troubleshoot the analysis service. This right ends when processing is no longer reasonably necessary, subject to the retention and legal exceptions in the Privacy Policy.
You are responsible for ensuring that you have the right to store Your Content and submit analysis details. Do not store or submit unlawful content, confidential information belonging to someone else, or material that infringes another person’s rights.
6. Acceptable use
You may not use the Services to break the law or facilitate harm; infringe rights; probe, disrupt, overload, bypass, or compromise the Services; use unauthorized automated access; misrepresent AI output as a verified survey, test, inspection, or professional opinion; reverse engineer except where law expressly permits; or resell or commercially exploit the Services without written permission.
7. Purchases and subscriptions
iOS purchases are processed by Apple under the terms displayed before confirmation. If an auto-renewing subscription is offered, its localized price, billing period, trial terms, and renewal terms will be shown before purchase. Payment is charged to the Apple Account, and renewal is managed by Apple. You can manage or cancel an Apple subscription in device settings or at Apple’s subscription-management page. Cancellation normally takes effect at the end of the current paid period. Refunds are governed by Apple’s policies and applicable law.
If a separate web subscription or purchase is offered, its price and recurring terms will be disclosed at checkout and the payment may be processed by Stripe. Cancellation instructions will be provided with the purchase or through the associated billing portal.
8. Intellectual property
PermaSage—including its software, branding, interface, original reference material, and design—is owned by Ecopoiesis or its licensors and protected by intellectual-property laws. These terms do not transfer ownership. References to third-party plant, geographic, or other factual information do not imply ownership of the underlying facts.
9. Third-party services
The Services rely on third parties including Apple for private CloudKit sync, maps, distribution, and purchases; Vercel for endpoint and website hosting; Anthropic for user-requested AI analysis; and other providers described in the Privacy Policy. Their services have separate terms and may become unavailable or change. We are not responsible for a third party’s independent services, content, or conduct except where applicable law provides otherwise.
10. Availability and data preservation
We do not guarantee uninterrupted or error-free operation. Online features require a working connection and may be unavailable because of maintenance, provider outages, safety concerns, or circumstances beyond our control. Sync depends on the Apple Account, iCloud storage, network connection, and Apple’s services. Keep a separate copy of information you cannot afford to lose.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Ecopoiesis disclaims implied warranties including merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. These disclaimers do not limit warranties or consumer rights that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, Ecopoiesis and its members, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost crops, plants, animals, yields, profits, opportunities, data, or goodwill arising from the Services. Ecopoiesis’s aggregate liability for a claim relating to the Services will not exceed the greater of the amount paid for PermaSage during the 12 months before the claim or US $100. These limits do not apply where prohibited or to liability that cannot lawfully be limited.
13. Termination
You may stop using PermaSage at any time. We may restrict an online feature if you materially violate these terms or if reasonably necessary to protect users, the Services, or others. Provisions that by their nature should survive—including ownership, disclaimers, and liability limits—will survive.
14. App Store license
The PermaSage iOS app is licensed, not sold. Unless Ecopoiesis supplies a separate custom license through the App Store, Apple’s Standard Licensed Application End User License Agreement applies to the app license. These Terms govern the PermaSage service and supplement that license. If a conflict concerns the app license, the applicable App Store license controls.
15. Changes, severability, and waiver
We may update these terms and will post the current version at this URL with its effective date. If a provision is unenforceable, it will be adjusted only as much as necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver.
